Habican – Customer Terms & Conditions
1. Introduction
Welcome to Habican, an online platform operated by Habican Pty Ltd (ABN 21 691 350 277), which connects customers with trusted, verified service providers for home repairs, maintenance, cleaning, gardening, and related home services (the Platform).
By accessing or using the Platform (including posting a job request), you agree to these Terms and Conditions (Terms). Please read them carefully before using the Platform.
If you do not agree with these Terms, you must not use the Platform.
2. How Habican Works
Customers submit job requests for specific services.
Habican matches or connects customers with relevant providers based on service type and location.
Providers contact customers directly to quote, schedule, and perform the requested service.
Habican acts as a facilitator only and is not a party to any contract between a customer and provider.
3. Your Responsibilities as a Customer
You agree to:
Provide true, current, and complete information when posting a job.
Communicate courteously and lawfully with providers.
Not post jobs for unlawful, unsafe, or prohibited activities.
Comply with all applicable laws (including work health and safety and consumer protection laws).
Deal directly with the provider regarding quotes, payments, warranties, and any disputes.
You acknowledge that:
Habican does not guarantee a match will be found for every request.
Habican does not supervise or control provider activities.
The outcome and quality of the services are the provider’s responsibility.
4. Accounts and Access
If you register or are provided an account:
You are responsible for maintaining the confidentiality of your login details.
You must not share your account or allow others to post jobs on your behalf without consent.
Habican may suspend or terminate access if it suspects misuse, fraud, or inaccurate information.
5. Payments
Habican provides its platform free of charge to customers.
All quotes, invoices, and payments for services are handled directly between you and the provider.
Habican does not collect or process any payments for services at this stage.
6. Provider Verification and Reliability
Habican conducts reasonable checks to improve customer confidence, such as verifying a provider’s ABN, business name, and any licences where applicable. However, Habican relies on information supplied by providers and third parties and cannot warrant the accuracy, currency, or ongoing validity of those details. You are encouraged to verify licences, insurance, and credentials independently before engaging a provider.
7. Platform Conduct and Prohibited Use
You must not:
Post false, misleading, or inappropriate job requests.
Use the Platform for any unlawful purpose.
Upload viruses, spam, or harmful content.
Interfere with or attempt to breach the security of the Platform.
Habican may remove any job posting or suspend your access if you breach these rules.
8. Disputes Between Customers and Providers
Any contract for services is between you and the provider. You are responsible for managing all communications, negotiations, and payments directly. Habican is not liable for disputes but may, at its discretion, assist with communication or provide referral information to external dispute resolution services.
9. Consumer Guarantees
Nothing in these Terms excludes or limits rights you may have under the Australian Consumer Law (ACL).
To the extent permitted by law:
Habican provides the Platform “as is” and does not make any representations or warranties about the quality, suitability, or legality of any provider or service.
Any guarantees regarding the services performed rest solely with the provider.
10. Indemnity
You agree to indemnify and hold harmless Habican, its directors, employees, and affiliates, against any claim, loss, damage, or cost (including legal fees) arising from:
Your breach of these Terms;
Your use of the Platform or reliance on its content;
Any dispute or interaction with a provider.
This indemnity survives the termination of your use of the Platform.
11. Limitation of Liability
To the maximum extent permitted by law:
Habican excludes all implied warranties and conditions not expressly stated.
Habican is not liable for any direct, indirect, or consequential loss, damage, or injury arising out of or in connection with:
Use of the Platform or reliance on information provided,
The performance (or non-performance) of a provider,
Any suspension, interruption, or error in the Platform.
If Habican is found liable and cannot lawfully exclude it, our total liability is limited to AUD $100 or the re-supply of the relevant service (whichever is lower).
12. Privacy
Habican collects, stores, and shares personal information as described in our Privacy Policy available at [insert link].
By using the Platform, you consent to your information being shared with providers for the purpose of connecting you to relevant services.
13. Intellectual Property
All content, design, software, and branding on the Platform are owned or licensed by Habican.
You may not copy, reproduce, or use any content for commercial purposes without written consent.
14. Suspension or Termination
Habican may suspend or terminate your access if:
You breach these Terms,
Provide false or misleading information,
Misuse the Platform or engage in unlawful activity.
Termination does not affect rights or obligations that have already accrued.
You may stop using the Platform at any time.
15. Changes to These Terms
Habican may update these Terms from time to time.
When we do, the revised version will be posted on our website and take effect immediately.
If you continue using the Platform after the update, you are deemed to have accepted the changes.
16. Platform Availability and Updates
Habican aims to provide a secure and reliable experience but does not guarantee uninterrupted access.
We may modify, suspend, or withdraw any part of the Platform without notice for maintenance or improvement.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of New South Wales, Australia.
You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales.
