Habican – Provider Terms & Conditions (NSW, Australia)
1. Introduction
Welcome to Habican, operated by Habican Pty Ltd (ABN 21 691 350 277).
Habican is an online platform that connects customers with trusted service providers for home repairs, maintenance, cleaning, gardening, and related home services (the Platform).
These Provider Terms & Conditions (Terms) apply to all individuals or businesses (you or Provider) who register with Habican or use the Platform to receive job leads or connect with customers.
By submitting your details, applying to join, or using the Platform in any way, you agree to these Terms.
If you do not agree, do not use or register with Habican.
2. How Habican Works
Customers submit job requests through the Habican website.
Habican matches or connects those requests to suitable Providers based on service type, location, and verification status.
Once matched, Providers may contact customers directly to quote, schedule, and perform the requested service.
Habican acts only as a facilitator and introducer, not as an employer, contractor, or agent of any Provider or customer.
No employment, partnership, or agency relationship exists between you and Habican.
3. Eligibility and Registration
To join Habican, you must:
Hold a valid Australian Business Number (ABN);
Be at least 18 years of age;
Have the appropriate licences, registrations, and insurances for the services you provide; and
Provide true, current, and complete information in your application and keep it updated.
Habican reserves the right to approve, decline, or remove any Provider at its sole discretion.
4. Verification and Provider Obligations
Habican undertakes reasonable checks, including ABN and licence verification, based on information you supply.
You acknowledge and agree that:
You are solely responsible for ensuring that your business, staff, and subcontractors comply with all applicable laws, safety requirements, and licensing obligations;
Habican relies on the information you provide and cannot warrant its accuracy or continuing validity;
You must promptly notify Habican of any change to your licence, insurance, or business details;
You must maintain current public liability insurance (and workers’ compensation if applicable).
Habican may remove or suspend you from the Platform if it becomes aware of any false, expired, or invalid credentials.
5. Service Delivery and Conduct
When performing services sourced through Habican, you agree to:
Communicate with customers promptly and professionally;
Provide accurate quotes and honour agreed pricing;
Perform all work safely, competently, and in accordance with applicable laws and standards;
Not engage in misleading, aggressive, or unethical conduct;
Ensure any staff or subcontractors representing you act lawfully and courteously.
You must not use the Platform to promote unlawful, unsafe, or unlicensed activities.
6. Fees and Payment
6.1 Free Access for Founding Providers
Providers accepted into the Founding Provider Program will receive free access to the Platform until 31 December 2026. No subscription fees or charges apply during this period.
6.2 Transition to Subscription Plans (Optional for Providers)
After 31 December 2026, Habican will introduce monthly subscription plans for Providers.
You will not be automatically subscribed or charged. Before any subscription fees apply:
You will receive at least 60 days’ advance notice;
You will be given full details of the subscription plans and pricing;
You may choose whether to continue with a paid subscription or close your provider account with no penalty.
To continue using the Platform beyond the free access period, Providers will need to actively opt in to a subscription plan and complete any required payment details.
6.3 Founding Provider Benefits
Founding Providers will receive a permanent discounted rate on Habican’s future subscription plans for as long as they choose to remain on the Platform.
6.4 Provider Payments
Habican does not process customer payments and does not take commissions. Providers will invoice and receive payment directly from customers.
7. No Guarantee of Leads or Work
Habican makes no guarantee of:
The number of job leads you will receive;
The suitability, accuracy, or reliability of any customer request; or
The likelihood of securing work through the Platform.
Habican provides introductions only. Whether a customer engages you is entirely at their discretion.
8. Provider Independence
You acknowledge that you operate as an independent business and not as an employee, subcontractor, or agent of Habican.
You are solely responsible for:
Your tax, superannuation, and business obligations;
Any tools, equipment, or materials used in providing services; and
Compliance with occupational health and safety requirements.
9. Ratings, Reviews, and Platform Content
Customers may leave feedback or reviews about their experience. Habican may display, moderate, or remove such reviews at its discretion but is not responsible for their content.
You must not post false reviews or attempt to manipulate ratings.
All content (text, images, and data) you upload must be accurate, lawful, and not infringe any third-party rights.
10. Privacy and Data Use
Habican collects and uses your personal information in accordance with the Habican Privacy Policy ([link]).
By joining Habican, you consent to your business and contact details being shared with customers for the purpose of connecting you to relevant jobs.
You must not misuse customer information or contact details obtained through the Platform for any purpose unrelated to the requested service.
11. Disputes with Customers
Any contract for services is strictly between you and the customer.
You are solely responsible for handling customer communications, complaints, and warranty obligations.
Habican may assist with communication but is not responsible for resolving disputes or compensating any party.
12. Consumer Guarantees and Compliance
You acknowledge that customers may have rights under the Australian Consumer Law (ACL).
You must comply with all obligations under the ACL, including guarantees relating to acceptable quality, fitness for purpose, and due care and skill.
You must not misrepresent your qualifications, insurance, or the nature of your business.
13. Indemnity
You agree to indemnify Habican, its directors, employees, and affiliates against any claim, loss, or damage (including legal costs) arising from:
Your breach of these Terms or any law;
Your negligence, misconduct, or misrepresentation; or
Any claim by a customer or third party related to your services.
This indemnity continues after you cease using the Platform.
14. Limitation of Liability
To the maximum extent permitted by law:
Habican excludes all implied warranties and conditions not expressly stated;
Habican is not liable for any loss, damage, or injury (including indirect or consequential loss) arising from:
Use of or reliance on the Platform;
Any act or omission of a customer;
Errors, interruptions, or delays in Platform access.
If Habican is found liable and cannot lawfully exclude it, liability is limited to AUD $100 or the re-supply of access to the Platform (whichever is less).
15. Suspension or Termination
Habican may suspend or remove your access if you:
Breach these Terms;
Provide false or misleading information;
Fail to maintain valid licences or insurance;
Receive serious or repeated customer complaints; or
Engage in conduct that may harm Habican’s reputation or operations.
You may close your account at any time by notifying Habican in writing.
Termination does not affect rights or obligations that have already accrued.
16. Updates to These Terms
Habican may update these Terms from time to time.
Updated versions will be published on the Habican website and take effect immediately.
Your continued use of the Platform constitutes acceptance of the revised Terms.
17. Intellectual Property
All content, design, branding, and materials on the Platform are owned or licensed by Habican.
You may use them only as reasonably necessary to use the Platform for its intended purpose.
You grant Habican a limited licence to display your business name, logo, and service information on the Platform for marketing and operational purposes.
18. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
Any disputes shall be resolved in the courts of New South Wales.
